Pools, spas and safety barriers

A building permit is required for the construction of all safety barriers and all types of pools and spas that can hold more than 300mm of water in depth. A permit is also required if you are installing new or altering any part of a swimming pool or spa safety barrier.

Specific regulations apply to barriers, fences, gates, catches, latches and self closing devices. They must meet Australian standards which are outlined on the Victorian Building Authority page.

All safety barriers must be well maintained to ensure children are restricted access to the pool and spa area.

When are barriers not required?

A safety barriers is not required for:

  • bird baths
  • fish ponds
  • fountains
  • dams
  • water storage tanks

Owner's however have a duty of care to ensure these are safe.

Swimming Pool and Spa Registration and Certificate of Compliance

New laws introduced by the Victorian Government require property owners to register their swimming pool and spa with Council.
All pools and spas must be registered and then inspected every four years.
